About the Author

Francis J. Mootz III is the author of Rhetorical Knowledge in Legal Practice and Critical Legal Theory (2006) and Law, Rhetoric and Hermeneutics (2010). He is editor of Gadamer and Law (2007) and Nietzsche and Law (2008, with Peter Goodrich). He is also the author of a law casebook, Commercial Transactions: Sales, Leases, and Computer Information, 2nd edition (2008, with David Frisch and Peter Alces). He has published numerous articles in a variety of journals, including law reviews and peer-reviewed journals. Professor Mootz is a regular presenter at academic symposia focusing on issues of legal theory. He is a member of the editorial advisory board of the interdisciplinary journals Law, Culture and the Humanities and International Journal for the Semiotics of Law and is a member of the Organizing Committee of the Association for the Study of Law, Culture and the Humanities. He is an active member of the Association of American Law Schools, the North American Society for Philosophical Hermeneutics, the Law and Society Association, the Society for Ricoeur Studies and the Rhetoric Society of America. He currently is the William S. Boyd Professor of Law at the University of Nevada, Las Vegas. Some argue that American jurisprudence from the standpoint of creativity and innovative approaches is pretty much dead. This interesting collection of some 35 articles surely refutes that contention. The collection traces its origin to a short 1934 law review article by Karl Llewellyn titled "On Philosophy in American Law" (the article is reprinted with its original pagination as the initial essay in the book). Llewellyn's article is a whirlwind tour of American legal philosophy from the revolution to the 1930's. Llewellyn makes it clear that while he can trace the origins of the various developmental stages in American legal thought, his real interest is law in action and if it meets social needs.In order to assess the current relationship between law and philosophy, the editor asked 40 or so leading contributors to the field to write short (4-6 page) essays on topics illustrating the role of philosophy in American law today. The results are very interesting and somewhat challenging. The best place to start is with the editor's own introduction; the three concluding essays which are commentaries on the essays also provide a useful structure for tackling the essays. The editor has grouped the essays under six categories which also helps orient the reader. Several points become clear as one reads the essays. First, there is enough creativity and energy represented here to light the city of Cleveland--American jurisprudence is well and alive. Second, over the last quarter century or so, many joint Ph.D.'s in philosophy and J.D.'s have begun to teach in law schools and to publish abundantly. This has resulted in (perhaps) unduly technical theories and philosophical constructs (yes I am thinking of Wittgenstein) being applied to American law. As some of the contributors recognize, there are few of us out here prepared to debate the fine points of "consequentialism," Gadamer, "virtue jurisprudence,"and Ricoeur on John Rawls. It would seem that American philosophy of law runs the risk of contracting into a smaller and smaller group of joint Ph.D.'s who spend there time talking and arguing with each other, rather than a broader readership. Fortunately, there are some folks such as Dennis Patterson who can carefully explain a philosophical concept so it is understandable, and then in a cogent manner apply it to a legal issue so that the result is exciting.Finally, the gap between legal philosophers and those of us who practice law has grown it seems. Not one essay I believe is written by a practitioner; some contributors (as would probably Llewellyn if he were still around) point this out and it bears some thought. Law and the philosophy of law should not be separated by a gigantic moat if philosophy is to play a meaningful role in the real world. All that being said, this is a stimulating collection that creatively touches on everything from psychoanalysis to hermeneutics to "Continental philosophy" to rhetoric and Raz, Postema, and Posner and lots in between. Because the essays are short, the reader does not get bogged down in lengthy technical discussions; the editor's goal seems to have been to get it out concisely or forget it. Key sources in each essay are identified at the conclusion of the article; each contributor is identified as to current position (including email adddress) and leading publications; a helpful name index is included. Llewellyn wanted us to take a fresh look at philosophy in American law--in some 300 pages the editor has abundantly accomplished that goal.

While able to demonstrate correlation, Pearl asserts that in classical statistics all relationships are two-way: that is 2x=3y+6 can also be written 3y=2x-6. We are left in doubt as to whether x causes y or y causes x.Fundamentally, Pearl sees this problem as still plaguing all artificial intelligence and statistics. In its place, Pearl argues that the exact causal relationship between all variables should be explicitly symbolized in graphical form and only then can mathematical operations tease out the precise causal effect.To be transparent, I am trained in the Rubin approach to causal inference and disagree with some of Pearl’s history and characterization of statistics. But that is not the point. The history is well-written, engaging and understandable by the lay reader. Similarly, his account of graphical causal inference theory is followable even for someone like myself who did not learn these techniques in graduate school.The last part of the book, where Pearl opines on the future of AI, is the most sensational. Pearl believes that if computers were programmed to understand his symbolization of causal inference theory they would be empowered to realize counterfactuals and thus engage in moral decision making. Furthermore, since Pearl himself was a pioneer in deep learning, his characterization of contemporary AI as hopelessly doomed in the quest to replicate human cognition because of a lack of understanding in causal inference will be sure to garner attention.But one would be misguided to think that speculations about AI or mischaracterizations of other kinds of causal inference make this book any less of a classic. For the first time, Pearl has written a popular, interesting and provocative book describing his branch of causal inference theory—past, present and future.This book is a must read then, not only for causal inference theorists, but more widely for those with any interest in contemporary developments in computer science, statistics or Artificial Intelligence. Wow! I am a physician epidemiologist with a doctorate in epidemiology and I teach computational epidemiology (with R) at UC Berkeley. I had the opportunity to study biostatistics from the best professors at UC Berkeley School of Public Health (Steve Selvin, Nicolas Jewell, Richard Brand, and many more). The field of causal inference was just beginning to take off with biostatisticians piloting the plane (Mark van der Laan, Nicolas Jewell, etc.). I avoided a rigorous study of causal inference but eventually came around after studying Bayesian networks for decision analysis (FYI: Pearl pioneered Bayesian networks). Judea Pearl's Bayesian networks and causal graphs connects the fields of statistics, epidemiology, decision and computer sciences in a profoundly elegant way. His work empowers and expands the potential of "big data." This is the first book written for the general public on this topic. It will have a **huge impact**. Causality and causal reasoning is at the core of everything we see, do, and imagine. He provides a graphical tool (causal graphs) for encoding expert knowledge (including community wisdom and experience). Anyone --- yes, anyone --- can learn the basics. For additional rigor, there are structural causal models (functional equations). I now consider it data science "malpractice" to design studies, analyze data, or adjust for confounders without using causal graphs. As he covers extensively in the history of causality, human brains are wired to resist new paradigms. Be intellectually wise and humble and read this book -- you will not regret it!

I hate to tell you this, but science, at least real science, has linked cause and effect. That's basically how science works. What this book is doing is trying to explain why the social "sciences" have yet to link cause and effect, and the simple answer is that the social "sciences" is not real science. The social world works by interweaving individual factors into social dynamics that create new emergent products. In science, you isolate variables to determine cause and effect. You can't do this with social systems. It's like trying to make sense of a sentence by separating each word and then each letter. The sentence only makes sense as a whole. This author is just trying to add more math and sciency formulas to the social sciences to make it look more scientific. I studied Economics. This is exactly what they do in Economics and have yet to prove anything or link any cause to effect, simply because economic systems are far too complex and can't be separated and isolated like a lab experiment. What the entire farce is doing is called obfuscation. If you are so confused by the math, technical jargon, sciency graphs and tables and data and figures, then you just feel dumb and agree with whatever idiotic conclusion the author invents. Look how cutting taxes and increasing federal spending stimulates the economy with all my sciency charts and formulas! It's an entire scam industry and this author is just like another grifter.

This book represents the collaboration of Judea Pearl, a professional expert on causality, and Dana MacKenzie, an excellent science writer who is also a mathematician. Admission -- I own and have read the prior edition. While I can't go line by line over the differences, this book is substantially thicker (yes, I know that thickness is a profound yardstick to compare the two editions), which indicates that a great deal of work has gone into this book.I disagree with Garner on some issues (such as defining parties in briefs), I really love the overall guidance. Keep in mind, though, that this is guidance. If you routinely appear in certain courts, you would be well served to go to a CLE at which one or more of the court's judges is speaking and try to determine his or her preferences. For instance, while my local federal appeals court has highly qualified and hard-working law clerks, the court of appeals for the state has no law clerks, which shifts certain burdens to the lawyers (e.g., if your adversary misstates the holding of an opinion, you can't assume that the court will catch it). Also, you should know whether to slavishly follow the local rules (some judges either ignore them or have their own orders which impose other requirements). Garner should have included a section dealing with these practical points.While this book is really good for younger attorneys, even old dogs like me can learn new tricks.

This book is a must. Even though it has the hideous word "tips" in the title, the book is organized and clear. Every time you turn the page you'll find another gem that will improve your writing. Some tips are global and overarching. For example, Garner at once exposes and destroys unconscious assumptions of the reader. Other tips are on a practical level like how to simplify the heading-subheading scheme so the reader understands your progression of arguments. And still other tips sound like a life coach teaching self discipline methods like clarifying what you need to know before you write. Worth the price. Keep on the shelf for long time to come.

I love this book but I was unable to get through it all because there are sooooooooo many pages. So it wasn't as useful for me because I was on a tight deadline of 2 weeks for writing a Moot Court Brief to get on to the board.But what I did read I certainly did apply, and I wrote the Best Brief for Moot Court because of this book.

Glad I bought this book, I am a nonlawyer but I still need to upgrade my writing skills every chance I get. I highly recommend this book for those of you who like to write and enjoy technical reading. I appreciate talking with attorneys over legal issues, and this is the type of book that can assist a person if your doing pro se work, and need to express your point of view in a coherent and intellectual manner. Sometimes Court administrator/judges, etc examine documents and it makes their day go a lot smoother when they can read a document or brief and clearly get the message without a lot of redundant and time-wasting lines of thought.

As a young lawyer, this is maybe the best legal writing book I've ever read. The advice is simple to follow and easy to apply. I keep this handy whenever I'm writing a brief or have a question about how to tackle a brief-related issue.Is it a little pricey? Yes. But it's worth it.

Best book I've read on legal writing ever. The only caveat I would add is that it is not as useful in law school, because real world law practice is so different than law school. Law school trains you in a particular way that ironically needs to be deprogrammed once you enter law practice in order to be a good writer and effective advocate. This book deprograms you of legalese. But if you read it while still in law school where legalese has a purpose--the purpose of making you start thinking as a lawyer--it undermines a process you need while still a student.For instance, stating issues in the "whether" format seems to be commonly expected in law school, while it is bad practice in memos and appellate briefs. This book aims to reverse many of the bad habits one acquires in law school--the legalese that served a purpose before you became a lawyer but which handicaps you for the rest of your career if you don't get deprogrammed. This book deprograms and provides new programming that makes you a better writer and advocate.

I love this book, but I am very disappointed in the Kindle edition. So be warned.I wanted a Kindle version of this terrific book because I wanted my own copy (I have borrowed a colleague's hard copy), and with my Kindle and iPad, I would always have it handy. As a way to read the book, this is great and helpful. But as a REFERENCE tool, it is nearly useless. There is no comprehensive table of contents to help you refer to past chapters to brush up on a particular topic. And the subject index--which is included--doesn't work. For example, when I look up "Mr., Ms. Mrs.," it refers to chapter 55 (which is right). But the link takes you to page 55, which is in the middle of chapter 8 and far from where you need to be. This simply isn't useful unless you are reading it only straight through.

This is one of the best legal writing books I've read. I had a settlement proposal I was working on. I decided to see if this book could give me some last minute polishing ideas. In 90 minutes the tips helped me sharpen my ideas so well that my work went from average to rockstar. I had to re read my introduction ten times because I did not believe I wrote it

I received this book, paperback binding in tact, the book unharmed, no bent pages. Everything looked great. After review a few chapters in, I decided to review the “test taking hints” and the pages located after chapter 11 only to find that they do not exist. The “Table of Contents” states the book should have a minimum of 793 pages, “References” located on page 793. Unfortunately for me, my book ends at page 768! My chapter 11 starts at page 759-786, so my chapter 11 is even incomplete - (have not gotten to this chapter yet for studying to notice this sooner than at this time.)None the less the product, the education I am receiving is great, and I am learning from this.

Great review book

As a person that loves all things organized, I couldn't have loved the layout of this book any more! Even the little touches with the tabs being easy to ready in the shape of crayons was too cute and made it easy when looking for the answers. The rationales were anything but boring. For a review book, this one was not only educational, but actually very funny at times. Thank you Mr. DeBoer for writing something people can actually use and will remember for every day practice!

This book is the reason for my passing the CPEN! Scott De Boer combined humor with a thorough explanation of Pediatric ER concepts. He presented cases in such a way that they're easy to remember and understand - both for the test and nursing practice. Wonderful book! Can't recommend it enough!

Do what all budding novelists do: start by emulating your favorite writer. This comes naturally to prose authors, but for screenwriters it's not so intuitive. Perhaps it's because we watch movies more than we read scripts, but for many writers their first script is written in a passionless, neutral tone. Well, that ain't going to stand out from the pack. Forget what they say about screenplays being "blueprints." Screenplays are symphonies... and you can't make music without passion and style. How do you find your style? Read a lot of scripts to see what the pros' voices sound like. JJ Abrams doesn't read like Aaron Sorkin, who doesn't read like Kurtzman and Orci. Analyze the speed of an Abrams script, or the patter of Sorkin's dialogue, and try to emulate it in your own writing. At first you'll just be copying. But then you'll see the underlying structure, the shape and cadence of a pro writer's style, and your own unique voice will start to take form. 3. Video game scripts benefit from mystery more than other screenplays. In game scripts, even more than other forms of writing, less is more. Partly this is because no player enjoys having control taken away from them--unskippable cutscenes, long intros and pages of elaborate backstory often feel like distractions from the gameplay. Trimming a few lines of NPC dialog, or shortening a popup text box by just a few sentences, can dramatically increase player engagement in the story. What they lose in understanding they make up for in, well, actually caring about your script. It's also because solving puzzles, exploring narratives and uncovering mysteries is what game players do. They're among the smartest, most engaged screen audiences because they have a direct stake in the story: they're playing it! This allows you to create the sense of a vast world through judicious sprinkling of story clues (as in Bioshock) or through clever use of atmosphere and background details (see Amnesia: The Dark Descent). Portal tells a gripping, life-and-death story with only two characters (one of whom is mute); much of that narrative success can be attributed to never explaining the situation or talking down to the player. In video games, you can write a mystery and expect your audience to engage with it... and probably solve it.

Are you working on a screenplay or a novel, right now? Then you will find this useful. It's not high-flown theory. This witty (sometimes snarky) book is a collection of 150 truly useful tips. (I suggest reading in brainstorming mode....Whenever something in Xander's text triggers a good idea in you, go write it down.)

I am not a professional screenwriter, just one who wants to give it a try. Reading these tips may sound too obvious for the "masters" of screenwriting but yet they are the minimum tasks or advices to follow to get your screenplay written properly. Good for starters.

Some great tips. Some are duh moments but duh moments we are often guilty of. Those little 'kicks in the pants' helps. Then there a those things that are perfectly acceptable in other writing forms but are screenwriting fails. Nice little 'heads up' all round. Enjoyable read even if you never plan to write a screenplay.

Just ask Xander Bennett, author of one of my favorite blogs, Screenwriting Tips You Hack (yes the book and the blog share the same name). I've been reading Xander's blog for about a year now and it's by far one of my favorite blogs (ranking up there with Scriptshadow). Each day Xander posts a new tip. They're usually only a few sentences long, but they're quite useful, such as, "`Wise beyond his years' is a character description cliché - and not a very useful or informative one." Xander is able to infuse humor into his short tips, and reading his blog may quickly deflate the ego of any amateur writer before proceeding to provide practical advice.Since I loved the blog I decided to give the book a try. I was worried that the book would be nothing but tips copied and pasted and bound together. What Xander smartly did was to divide the book into chapters about different ideas. There's a chapter on creating ideas, writing description, dialogue, rewriting, and much more. Within each chapter he presents a series of tips. Yes, all of the tips look like they came straight from his blog. But, most tips usually comes with a page or two of deconstruction. He offers more detail, offers up good and bad examples, and takes time to show us the right way and the wrong way. There are usually a few tips at the end of each chapter without the extra explanation, but they usually serve as a good closing to the idea.Having experience as both a script reader and a writer, I could tell while reading that Xander definitely knows what he's talking about. His writing style is engaging, and given the way that he seems to understand screenwriting, I am interested in reading some of his writing. In fact, that seems to be the main thing lacking. In the bio, Xander is said to have written for TV, film, and video games. I was hoping to see some references to situations regarding these, or at least to see some of his works listed. When I didn't find any I checked the blog, but to no avail. While I don't doubt him, I thought this would've added a strong element to the book. It would also encourage readers to engage with stories he's written, and surely that couldn't be bad thing.Though some of the tips may seem obvious, or redundant from other screenwriting books, Xander manages to either put a fresh spin on it, or at least include bits of humor. This is a book I definitely plan to have ready as a reference whenever I am writing. The unique style both separates it from other screenwriting books and makes it easy to skim and return to points of interest. Since the blog still continues, with new tips being constantly added, I hope that he is able to publish another one. IF he does, there will definitely be a place on my bookshelf for it.4.5/5 stars

The other one is Writing Movies for Fun and Profit by Thomas Lennon and Robert Ben Garant. Both riddled with good advice that isn't smothered in McKee flavored gravy and sprinkled with Save the Cat. ( I actually like the cat book)Best thing is they're funny and quick, which means I can get back to writing, which is the important part.Buy this.

Xander Bennett is honest, and approachable and clearly interested in providing useful information to interested writers.. His advise is to the point and has helped me navigate my way to a complete first draft. Thank You, Xander!!!

Such a helpful book

i got this on my ipadits kinda hard to follow because of the complexity of the "equations"that often require you to flip through the pages back and forth several timesso my adivce to you, if your bookstore has this, better get the hard copybut it is indeed useful
